Terms and Conditions – Focus Fotos

These Terms and Conditions apply to photography services provided by Focus Fotos, based in Gozo, Malta. By booking or using our services, you agree to the following terms.

1. Booking and Deposit

A booking is confirmed once a deposit has been paid and the date has been agreed between the client and Focus Fotos.

The deposit secures the date and is non-refundable, as the photographer reserves that date exclusively for the client.

The remaining balance must be paid according to the agreement made at the time of booking.

2. Photography Style

Clients acknowledge that they are familiar with the style of photography provided by Focus Fotos. Photography is an artistic process, and images will be captured and edited according to the photographer’s creative judgement and professional style.

3. Delivery of Images

All delivered images will be professionally edited and provided in high resolution.

Images are typically delivered through an online gallery or digital download, and may also be provided on USB where applicable.

Delivery times may vary depending on the project but are usually within a reasonable timeframe after the event or photoshoot.

4. Image Selection

Focus Fotos will select and edit the best images from the session or event according to the chosen package. Images that do not meet professional standards (e.g., closed eyes, test shots, duplicates, or technical errors) will be excluded.

5. Copyright and Usage

All photographs remain the copyright of Focus Fotos.

Clients receive a personal-use license, allowing them to:

  • Print the photographs

  • Share them on social media

  • Use them for personal purposes

Images may not be sold, altered, or used for commercial purposes without written permission from Focus Fotos.

6. Photographer Usage Rights

Focus Fotos reserves the right to use photographs for:

  • Portfolio display

  • Website galleries

  • Social media

  • Promotional or marketing materials

If a client wishes to request that images remain private, this should be discussed in advance by an email or message.

7. Cancellations and Rescheduling

If a client cancels a booking, the deposit is non-refundable.

If a session must be rescheduled due to weather, illness, or unforeseen circumstances, both parties will make reasonable efforts to agree on a new date.

8. Limitation of Liability

While every effort is made to ensure high-quality service, Focus Fotos will not be held responsible for circumstances beyond its control, including but not limited to:

  • Weather conditions

  • Venue restrictions

  • Interference from guests

  • Technical failures beyond reasonable control

In the unlikely event of equipment failure or loss of images, liability will be limited to the amount paid by the client.

9. Force Majeure

Focus Fotos shall not be held liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, illness, accidents, or other unforeseen events.

10. Governing Law

These Terms and Conditions shall be governed by the laws of Malta.
